These Terms of Service ("Terms") govern your access to and use of the Swiftcierge website, applications, and services (the "Service"). By accessing or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. The service
Swiftcierge provides an enterprise voice-AI receptionist platform that answers and places calls, books and manages appointments, qualifies leads, and provides related operations tooling. Features may change over time. A separate order form or enterprise agreement may supplement these Terms and controls in the event of a conflict.
3. Accounts & eligibility
- You must provide accurate information and keep your credentials secure.
- You are responsible for activity under your account and your users' accounts.
- The Service is intended for business use by users aged 18 or older.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or fraudulent purposes.
- Place calls that violate telemarketing, do-not-call, or consent laws.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Upload content you do not have the right to use, or that infringes others' rights.
- Use the Service to generate unlawful, harassing, or misleading communications.
5. Telephony & calling compliance
You are responsible for ensuring your use of inbound and outbound calling complies with applicable laws, including the TCPA, do-not-call rules, call-recording consent requirements, and local calling-hours restrictions. You are responsible for obtaining any required consents and for the content of scripts and campaigns you configure. Our tools provide guardrails (calling-hours, consent capture, opt-out honoring) but do not replace your legal obligations.
6. Customer data
You retain all rights to content and data you submit ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and secure the Service. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Addendum. We do not use Customer Data to train foundation models.
7. Fees & billing
- Paid plans are billed in advance on a monthly or annual basis, plus usage-based charges where applicable.
- Fees are non-refundable except as required by law or expressly stated.
- We may change pricing with notice effective at your next billing cycle.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by Swiftcierge and its licensors. Except for the rights expressly granted here, we reserve all rights.
9. Third-party services
The Service integrates with third parties such as telephony carriers, email providers, and OAuth identity providers. Your use of those services may be subject to their own terms, and we are not responsible for third-party services.
10. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be inaccurate; you are responsible for reviewing outputs before relying on them.
11. Limitation of liability
To the maximum extent permitted by law, Swiftcierge will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us in the twelve months preceding the claim.
12. Indemnification
You will indemnify and hold Swiftcierge harmless from claims arising out of your Customer Data, your calling campaigns, or your violation of these Terms or applicable law.
13. Term & termination
These Terms remain in effect while you use the Service. We may suspend or terminate access for breach or to comply with law. On termination, your right to use the Service ceases and Customer Data is handled per your agreement and our Privacy Policy.
14. Changes to these Terms
We may update these Terms; material changes will be posted here with a new "last updated" date. Continued use constitutes acceptance.
15. Governing law
These Terms are governed by the laws applicable to your order form or, absent one, by the laws where Swiftcierge is established, without regard to conflict-of-laws rules.
